A senior Justice Department official told ABC News that federal law enforcement officials are invoking the public safety exception to the Miranda rights, so that Tsarnaev will be questioned immediately without having Miranda rights issued to him.

See, that's the funny thing. For a person's rights to be waived before conviction is known as extra-judicial punishment, which the US government itself says is the hallmark of unjust (oppressive, tyrannical) regimes. I guess the US government considers itself to be "above" such analysis, though.
