Government!

A senior Justice Department official told ABC News that federal law enforcement officials are invoking the public safety exception to the Miranda rights, so that Tsarnaev will be questioned immediately without having Miranda rights issued to him.

The federal government's high value detainee interrogation group will be responsible for questioning him.

The Miranda exemption exists to protect the public safety from another attack, according to the official.

This is it.

Was he an american citizen? He should be protected by the law. No matter what crime.

Hey, man, it's a matter of national security. The federal government can do whatever it wants.

The Miranda warning is always optional

"While arrests and interrogations can legally occur without the Miranda warning being given, this procedure would generally make the arrestee's pre-Miranda statements inadmissible at trial. (However, pursuant to the majority opinion in United States v. Patane, physical evidence obtained as a result of pre-Miranda statements may still be admitted.)" - http://en.wikipedia.org/wiki/Miranda_rights

See, that's the funny thing. For a person's rights to be waived before conviction is known as extra-judicial punishment, which the US government itself says is the hallmark of unjust (oppressive, tyrannical) regimes. I guess the US government considers itself to be "above" such analysis, though.
