From the perspective of most economists, what incentives and constraints created the development of law across human civilization?

Under what incentives and constraints were property laws defined and refined across time?

How was it that human civilization created such clear and detailed property laws and contract laws across centuries despite ruling despots who'd presumably have the least interest in seeing laws that they couldn't abridge for their own interests?
